Life of Your Case

Although each case plan is specifically tailored
to meet individual circumstances, you can
generally expect your case to follow this process:

1

DETERMINING EXPOSURE TO ASBESTOS

Your mesothelioma diagnosis might have been delivered last week, but your critical exposure to asbestos occurred decades ago. Our tenacious team knows what questions to ask of the right people in order to uncover the truth about your link to deadly asbestos.

2

FINDING RESPONSIBLE PARTIES

Once we have a general understanding of where, how, and when your asbestos exposure occurred, our team will begin to identify which manufacturers, distributors, contractors or others are responsible for your mesothelioma.

3

WE SUE ON YOUR BEHALF

We promptly file a document known as a complaint/petition, which provides details about your claim against those specific companies. This means taking your case to the courtroom of a judge who understands the mesothelioma lawsuit process and the timeliness necessary for victims who are suffering from this devastating disease.

4

TRIAL DATE IS SELECTED

Trial dates are selected with due process in mind. We take a deliberate approach in preparing evidence and witnesses that support your claim for damages, and the other side must do the same in mounting its defense.

5

DISCOVERY PHASE

With the trial date set, your case enters the discovery phase. The purpose of the discovery phase is twofold: to prepare for a jury trial and to gather information for settlement discussions between the lawyers for the companies and our team on your behalf.

6

A DEPOSITION ALLOWS YOU TO BE HEARD

Your primary commitment to the legal case is a deposition, which is your testimony but not in a courtroom. At a convenient time, you will be questioned at a site near your home or in our St. Louis office by our attorneys and attorneys on the other side. Rest assured, we will control the environment and put you at ease. Between the time of the deposition and the start of the trial, nothing further will be required of you, the plaintiff.

7

TRIAL OR SETTLEMENT

Mesothelioma lawsuits frequently will be resolved with multiple defendants before a trial begins. For many people, this is the desired outcome. Although only 10% of our cases proceed to a full trial, we are 100% prepared and dedicated to trying your case if it does not settle.

8

COMPENSATION

Our team works on a contingency basis and only receives fees with a settlement or trial victory. Basically, our fee is paid out of the compensation from the responsible parties, so if you do not receive compensation, you do not pay us.
